These Terms of Service apply to all users of CVHound.com, including jobseekers, candidates, employers, hiring companies, internal recruitment teams, authorised company representatives, HR contacts, accounts contacts, finance contacts, and any other person or organisation that accesses or uses CVHound.com.

CVHound.com is operated by Hampshire Barnes Ltd, a company registered in England and Wales.

By accessing or using CVHound.com, creating an account, uploading a CV, uploading a resume, building a profile, purchasing a subscription, accessing candidate profiles, submitting an interview request, accepting fee terms, contacting a candidate, accepting an interview request, responding to a candidate or employer, uploading an offer letter, confirming a hire, responding through an emailed secure link, or otherwise using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use CVHound.com.

1. Definitions

In these Terms:

“CVHound.com”, “CVHound”, “we”, “us”, or “our” means Hampshire Barnes Ltd, trading through the CVHound.com platform.

“Hampshire Barnes Ltd” means the operator of CVHound.com, which is also a UK registered recruitment company that may directly recruit Candidates for roles on behalf of its own clients.

“Platform” means the CVHound.com website, software, database, employer dashboard, candidate dashboard, candidate search tools, communication tools, AI-assisted processing tools, matching tools, profile tools, billing tools, document upload tools, email response tools, secure email links, and related services.

“User”, “you”, or “your” means any person or organisation that accesses or uses CVHound.com, including Candidates and Employers.

“Candidate” or “Jobseeker” means an individual who creates a candidate account, uploads a CV or resume, builds a profile, makes themselves searchable, or otherwise uses CVHound.com to seek employment, contract opportunities, freelance work, consultancy work, temporary work, permanent work, fixed-term work, project-based work, or other paid work opportunities.

“Employer” means a company, organisation, hiring entity, internal recruitment team, authorised company representative, HR contact, accounts contact, finance contact, hiring manager, or business user accessing or using CVHound.com to search for, review, contact, interview, shortlist, or hire Candidates.

“Profile” means a Candidate’s CV, resume, profile information, AI-generated summary, skills, work history, qualifications, location, availability, salary expectations, preferences, role interests, work authorisation details, and other information submitted to or generated by the Platform.

“Candidate Data” means any personal data, CV information, resume information, employment history, skills, qualifications, experience, location, availability, salary expectations, profile information, communications, interview records, offer letters, salary information, platform activity records, or other information relating to a Candidate.

“Employer Data” means information relating to an Employer, including company details, user account details, HR contact details, accounts contact details, finance contact details, subscription information, billing information, interview requests, hiring activity, communications, candidate view records, offer-letter records, invoice records, secure-link responses, and Platform activity.

“AI Output” means information extracted, summarised, structured, classified, ranked, suggested, matched, parsed, or generated by artificial intelligence tools used by CVHound.com to process Candidate CVs, resumes, Candidate Profiles, employer searches, offer letters, salary information, or related Platform data.

“Subscription Fee” means the annual or other recurring fee paid by an Employer to access CVHound.com employer features. Unless otherwise stated on the Platform or agreed in writing, the annual Employer Subscription Fee is £4,999 per year.

“Placement Fee” means the fee payable by an Employer to CVHound.com when the Employer hires, engages, contracts with, employs, or otherwise retains a Candidate introduced through CVHound.com. Unless otherwise stated on the Platform or agreed in writing, the Placement Fee is 5% of the applicable salary, remuneration, or fee basis described in these Terms.

“Introduction” means the point at which, following an interview request made by an Employer through CVHound.com, CVHound.com unlocks or makes available to that Employer the Candidate’s CV, resume, full name, contact details, LinkedIn profile, specific past-employer details, or other restricted identifying Candidate information. For the avoidance of doubt, browsing, searching, viewing an anonymised profile, shortlisting, or saving a Candidate does not by itself constitute an Introduction.

“Hire” means any employment, contract engagement, consultancy arrangement, freelance arrangement, temporary assignment, permanent role, fixed-term role, secondment, paid trial, project engagement, statement-of-work engagement, or any other paid work arrangement between an Employer and a Candidate.

“Advertised Maximum Salary” means the highest salary, salary range figure, remuneration figure, expected package value, day-rate equivalent, annualised contract value, or other maximum pay figure entered, advertised, posted, disclosed, or represented by the Employer for the relevant role.

“Confirmed Start Salary” means the Candidate’s actual agreed starting base salary, annualised contract value, or other agreed starting remuneration, as evidenced by an offer letter, employment contract, contractor agreement, statement of work, or other evidence accepted by CVHound.com.

“Offer Letter” means an offer letter, employment contract, contractor agreement, statement of work, written offer, salary confirmation, or other document showing the Candidate’s actual agreed starting salary, rate, remuneration, start date, or engagement terms.

“Candidate Bonus” means the candidate payment described in Section 18, where expressly offered by CVHound.com, equal to 1% of Confirmed Start Salary, capped at £/€/$1,000, subject to the conditions in these Terms.

“Secure Email Link” means a unique link sent by CVHound.com to an Employer-supplied contact email address that allows the recipient to confirm, reject, update, or respond to a start-confirmation request, pro-forma notice, invoice query, placement record, or other Platform workflow without logging into the Employer account.

“Applicable Data Protection Laws” means all applicable privacy and data protection laws that may apply to the relevant processing activity, including, where applicable, the UK GDPR, the Data Protection Act 2018, the EU GDPR, and any local privacy or data protection laws that apply in the relevant country or territory.

2. About CVHound.com

CVHound.com is an online recruitment technology platform that allows Candidates to make their CV, resume, and Profile available to subscribed direct Employers and to Hampshire Barnes Ltd for genuine recruitment purposes.

CVHound.com helps Employers source Candidates directly and reduce reliance on traditional recruitment agencies.

CVHound.com may also be used by Hampshire Barnes Ltd to review, search, process, match, and use Candidate CVs, resumes, Profiles, AI Output, and related Candidate Data for the purpose of identifying suitable employment, contract, consultancy, freelance, temporary, permanent, fixed-term, project-based, or other paid work opportunities for Candidates.

Hampshire Barnes Ltd may contact Candidates about roles it is recruiting for on behalf of its own clients where the Candidate has created an account, uploaded a CV or resume, made a Profile searchable, or otherwise consented to recruitment contact.

CVHound.com is not an employer of Candidates.

CVHound.com does not guarantee that any Candidate will be contacted by an Employer, receive interview requests, receive job offers, secure work, or achieve any particular outcome.

CVHound.com does not guarantee that any Employer will find suitable Candidates, receive Candidate responses, secure interviews, or make successful hires.

Use of CVHound.com is currently free for Candidates.

Employers may be required to purchase a subscription and must pay Placement Fees where they hire Candidates introduced through CVHound.com.

3. Platform Role

CVHound.com provides technology that helps connect Candidates and Employers.

CVHound.com may also be used by Hampshire Barnes Ltd to contact Candidates about roles it is recruiting for on behalf of its own clients.

CVHound.com is not responsible for the final hiring decision, employment relationship, contract terms, salary negotiation, onboarding process, working conditions, employment checks, right-to-work checks, references, qualification checks, immigration checks, background checks, tax arrangements, worker classification, contractor classification, or any dispute between a Candidate and an Employer.

Employers remain responsible for their own recruitment decisions, due diligence, screening, interviews, employment checks, right-to-work checks, immigration checks, references, qualification checks, offer terms, contracts, onboarding, and compliance with employment, equality, immigration, tax, privacy, and data protection laws.

Candidates remain responsible for the accuracy of their CVs, resumes, Profiles, qualifications, work history, salary expectations, availability, location, work authorisation status, and other information they provide through the Platform.

4. Eligibility

4.1 Candidate Eligibility

To use CVHound.com as a Candidate, you must:

  1. be at least 18 years old;
  2. be legally permitted to work in at least one country;
  3. be using the Platform on your own behalf and not on behalf of another person;
  4. provide accurate, complete, and truthful information;
  5. comply with all applicable laws.

You must not create a Candidate account if you do not meet these requirements.

We may refuse, suspend, restrict, or terminate access where we reasonably believe that a Candidate is under 18, has provided false information, has impersonated another person, has misused the Platform, has breached these Terms, or may create legal, security, regulatory, commercial, or reputational risk for CVHound.com, Hampshire Barnes Ltd, Employers, or other users.

4.2 Employer Eligibility

To use CVHound.com as an Employer, you must:

  1. be acting on behalf of a genuine hiring company or organisation;
  2. have authority to bind that company or organisation to these Terms;
  3. provide accurate, complete, and up-to-date account information;
  4. use the Platform only for genuine recruitment and hiring purposes;
  5. comply with all applicable laws, including employment, equality, anti-discrimination, immigration, tax, privacy, and data protection laws.

We may refuse, suspend, restrict, or terminate access to the Platform where we believe that an Employer is not a genuine hiring organisation, has provided false information, has misused Candidate Data, has breached these Terms, or may create legal, commercial, security, regulatory, or reputational risk for CVHound.com, Hampshire Barnes Ltd, Candidates, or other users.

5. Account Registration, Employer Contacts, Secure Email Links, and Security

You are responsible for keeping your account login credentials secure and for all activity carried out through your account.

You must not share your account access with unauthorised users or allow any unauthorised person to use your account.

Where the Platform currently provides one login for an Employer company, the Employer is responsible for ensuring that only authorised representatives access that login or act on the Employer’s behalf.

Employers may provide separate owner, HR, recruitment, hiring manager, finance, billing, and accounts contact details. The Employer confirms that it has authority to provide those contact details and that CVHound.com may use those contact details to send account, subscription, interview, start-confirmation, pro-forma, invoice, placement-fee, service, and legal communications relating to the Employer’s use of the Platform.

CVHound.com may send start-confirmation requests, pro-forma notices, invoices, reminders, secure links, and related communications to the Employer owner contact, HR contact, accounts contact, finance contact, hiring manager, or any other contact supplied by the Employer.

The Employer is responsible for ensuring that all contact details it supplies are accurate, current, secure, and monitored by authorised personnel.

Where CVHound.com sends a Secure Email Link to an Employer-supplied email address, the Employer agrees that any action taken through that Secure Email Link by the recipient or by anyone with access to that email account may be treated by CVHound.com as an action taken on behalf of the Employer.

Actions taken through Secure Email Links may include confirming a Candidate start date, confirming that a Candidate did not start, updating a start date, responding to a pro-forma notice, responding to an invoice query, confirming salary information, uploading or providing salary evidence, or otherwise responding to a Platform workflow.

The Employer must promptly notify CVHound.com if any Employer-supplied contact email address is no longer authorised, is no longer monitored, is compromised, or should no longer receive Secure Email Links or billing-related communications.

You must notify CVHound.com promptly if you become aware of any unauthorised access to or misuse of your account, contact email address, or Secure Email Link.

You must keep your email address, password, company information, Profile information, billing information, and other account details reasonably up to date.

CVHound.com may suspend or restrict accounts where we reasonably suspect unauthorised access, misuse, fraud, security risk, inaccurate information, or breach of these Terms.

6. Candidate Profile Accuracy and CV/Resume Content

Candidates must only upload CVs, resumes, and Profile information that:

  1. are accurate, truthful, and not misleading;
  2. relate to the Candidate personally and not to any other person;
  3. the Candidate has the legal right to upload and share;
  4. do not infringe the rights of any third party;
  5. do not contain unlawful, defamatory, discriminatory, offensive, or misleading content;
  6. do not contain malicious software, viruses, or harmful code.

Candidates must not impersonate another person, fabricate qualifications, fabricate employment history, exaggerate credentials in a misleading way, or upload CVs or resumes belonging to other people.

If a Candidate’s Profile information becomes inaccurate or out of date, the Candidate should update it or, where appropriate, request deletion of their account.

CVHound.com may remove, suspend, restrict, or edit the visibility of Profiles where we reasonably believe they are inaccurate, fake, misleading, unlawful, or in breach of these Terms.

7. Sensitive Information in Candidate CVs/Resumes

CVs, resumes, and Profiles can sometimes contain sensitive or special category personal data, such as information about health, disability, race, ethnic origin, religious beliefs, political opinions, trade union membership, sexual orientation, or criminal convictions.

Candidates should not upload such information unless it is genuinely relevant to their job search and they are comfortable sharing it with Employers and with Hampshire Barnes Ltd.

Candidates are responsible for the content of their CV, resume, and Profile.

We recommend that Candidates review their CV or resume before uploading it and remove any sensitive information they do not wish to share.

Where the Platform presents a sensitive data acknowledgement, upload notice, checkbox, or consent prompt, Candidates must read and accept it before uploading their CV or resume.

Employers must process any sensitive or special category personal data only where lawful, necessary, relevant, and appropriate for the recruitment process.

Employers must not use sensitive information to discriminate unlawfully against Candidates.

Employers must comply with all applicable equality, employment, privacy, and data protection laws when reviewing Candidate Profiles and making recruitment decisions.

8. CV/Resume Upload, Pre-Account Parsing, and AI-Assisted Processing

CVHound.com may use artificial intelligence and automated tools to assist with extracting, structuring, summarising, classifying, matching, parsing, analysing, and presenting information from Candidate CVs, resumes, Profiles, Offer Letters, salary documents, and related Platform data.

A Candidate’s CV or resume may be parsed during the sign-up or upload process before the Candidate account is fully created, in order to pre-fill registration fields, generate a draft Profile, extract structured data, improve the sign-up process, and help the Candidate review and complete their account.

By uploading a CV or resume during sign-up or before account creation, the Candidate requests CVHound.com to process that CV or resume for the purpose of taking steps to create the Candidate account, pre-fill registration details, generate a draft Profile, and provide the requested Platform service.

Where the Platform presents an upload notice, checkbox, consent prompt, or acknowledgement before CV/resume upload, the Candidate must read and accept it before uploading the CV or resume.

If the Candidate does not complete account creation, CVHound.com may delete, anonymise, or temporarily retain the uploaded CV/resume and related parsing records in accordance with the Privacy Policy, security requirements, fraud prevention, error recovery, and legal obligations.

AI Output may include job titles, skills, work history summaries, qualifications, locations, availability, salary expectations, sectors, keywords, role matches, experience levels, salary figures, remuneration figures, and other searchable or billing-related fields.

AI Output may not always be complete, accurate, current, or suitable.

Candidates may be given the opportunity to review, correct, and update AI Output before their Profile becomes searchable, where this review process is made available through the Platform.

Where AI Output is used to assist with salary extraction, fee calculation, pro-forma generation, invoicing, matching, or other Platform functions, CVHound.com may apply human review, manual checks, document review, or employer/candidate confirmation before relying on such information for billing or enforcement purposes.

CVHound.com does not use AI Output to make final hiring decisions on behalf of Employers.

Employers must not rely solely on AI-generated summaries, AI classifications, AI match suggestions, AI salary extraction, or AI Output when making recruitment, hiring, salary, or legal decisions.

Employers remain responsible for conducting their own assessment, interviews, checks, and due diligence before making any hiring decision.

9. Candidate Consent to Profile Visibility and Recruitment Contact

By creating a Candidate account and making a CV, resume, or Profile searchable, the Candidate consents to:

  1. their Profile, CV, resume, AI Output, and related Candidate Data being shown to subscribed direct Employers using CVHound.com for genuine recruitment purposes;
  2. Hampshire Barnes Ltd reviewing, searching, processing, matching, analysing, and using their Profile, CV, resume, AI Output, and related Candidate Data to identify potentially suitable opportunities;
  3. Hampshire Barnes Ltd contacting the Candidate about roles it is recruiting for on behalf of its own clients;
  4. their Profile, CV, resume, AI Output, and related Candidate Data being processed by CVHound.com’s AI tools for the purpose of structuring, presenting, matching, analysing, and searching their data;
  5. CVHound.com sending service emails, interview requests, account notifications, security messages, hire-status enquiries, candidate bonus communications where applicable, and other communications relating to their use of the Platform.

Candidates can withdraw consent at any time by deleting their account through their dashboard where that functionality is available, or by emailing CVHound.com.

Withdrawing consent will remove the Candidate’s Profile from active employer search results, stop new employer introductions being made through the Platform, and stop Hampshire Barnes Ltd contacting the Candidate about new roles, unless another lawful basis applies.

Withdrawing consent will not affect communications already in progress with an Employer who has received the Candidate’s details through an accepted interview request, records that CVHound.com is required or permitted to retain under applicable law, records retained for legal, tax, accounting, audit, fraud prevention, security, dispute resolution, regulatory, or contractual enforcement purposes, or previous lawful processing carried out before consent was withdrawn.

10. Candidate Contact Details and Privacy Controls

To protect Candidate privacy, certain Candidate details are not visible to Employers until the Candidate accepts an interview request through the Platform or otherwise consents to disclosure.

Restricted details may include the Candidate’s full name, email address, telephone number, LinkedIn profile URL, specific past-employer company names, and other identifying information.

Once a Candidate accepts an interview request, the relevant Employer may be given access to additional Candidate contact information for the purpose of progressing the recruitment process.

Candidates can choose whether to accept any interview request. Candidates are under no obligation to accept, respond to, or attend an interview, continue discussions, or accept any role.

Employers must not attempt to identify, contact, track, locate, or bypass privacy restrictions relating to Candidates.

Employers must not attempt to reverse engineer, infer, scrape, match, or identify restricted Candidate information using external tools, search engines, social media platforms, recruitment databases, browser extensions, AI tools, or other methods.

11. Employer Access to Candidate Profiles

Employers may be given access to Candidate Profiles in a structured and searchable format.

Candidate Profiles may include information extracted from CVs, resumes, Profile submissions, Candidate-provided details, and AI-assisted data processing.

Employers may only use Candidate Profiles and Candidate Data for genuine recruitment purposes.

Employers must not use Candidate Profiles or Candidate Data for:

  1. marketing;
  2. sales outreach;
  3. resale;
  4. data broking;
  5. speculative mass-mailing;
  6. unrelated job opportunities without appropriate consent;
  7. adding Candidates to external mailing lists;
  8. building an external recruitment database;
  9. contacting Candidates on behalf of another company unless expressly authorised;
  10. any non-recruitment purpose.

12. Interview Requests and Fee-Term Acceptance

Employers may submit interview requests to Candidates through the Platform.

When an Employer requests an interview, the Employer may enter or confirm role details, including the Advertised Maximum Salary for the role.

Before submitting an interview request, the Employer may be required to accept or confirm the applicable Placement Fee terms, salary basis, advertised-maximum fee basis, non-circumvention obligations, evidence-based discount mechanism, deemed-confirmation process, and billing process.

The Employer agrees that submitting an interview request, clicking to accept the fee terms, or otherwise proceeding with an interview request constitutes acceptance of the applicable Placement Fee terms for that Candidate.

CVHound.com may record the Employer’s acceptance of fee terms, including timestamp, user ID, account details, Candidate ID, role details, advertised salary details, IP address, and related Platform activity.

A Candidate is under no obligation to accept an interview request, respond to an Employer, attend an interview, continue discussions, or accept a role.

Where a Candidate accepts an interview request, CVHound.com may release additional Candidate contact details or Profile information to the Employer for the purpose of progressing the recruitment process.

Employers must use Candidate contact details only for genuine recruitment purposes relating to the specific opportunity for which the Candidate was contacted.

If a Candidate accepts an interview request and subsequently receives an offer of employment, contract engagement, freelance work, consultancy work, fixed-term work, temporary work, project work, paid trial work, or any other paid work arrangement from an Employer introduced through CVHound.com, the Candidate agrees to:

  1. respond to reasonable hire-status enquiries from CVHound.com;
  2. confirm honestly whether they have accepted a role with that Employer;
  3. not knowingly assist an Employer in concealing, misreporting, delaying, or disguising a Hire to avoid Placement Fees due to CVHound.com.

CVHound.com may contact Candidates after an Employer interview to confirm the outcome, expected start date, actual start date, salary, and placement status.

Employers must notify CVHound.com if they hire, engage, contract with, employ, or otherwise retain a Candidate introduced through CVHound.com.

13. Introductions, Placement Fees, and Non-Circumvention

CVHound.com records certain Employer activity on the Platform, including but not limited to profile views, searches, shortlists, interview requests, accepted interview requests, communications, salary details, role details, secure-link responses, and hire-related activity.

Where an Employer is introduced to a Candidate through CVHound.com, that Introduction is recorded and may be used as evidence that the Candidate was sourced through the Platform.

If an Employer hires, engages, contracts with, employs, or otherwise retains a Candidate introduced through CVHound.com, the Employer must notify CVHound.com and pay the applicable Placement Fee.

Unless otherwise stated on the Platform or agreed in writing, the Placement Fee is 5% of the applicable salary, remuneration, or fee basis described in these Terms.

Unless otherwise agreed in writing, the Employer must not attempt to avoid, reduce, delay, or circumvent payment of a Placement Fee by:

  1. contacting a Candidate outside the Platform after discovering the Candidate through CVHound.com;
  2. asking the Candidate to apply directly through another channel;
  3. using another company, recruiter, agency, related entity, group company, subsidiary, affiliate, contractor, partner, client, or intermediary to engage the Candidate;
  4. hiring the Candidate after the Employer’s subscription expires;
  5. hiring the Candidate for a different role after discovering the Candidate through CVHound.com;
  6. claiming that the Candidate was found through another source after viewing, accessing, or communicating with the Candidate through CVHound.com;
  7. delaying the Hire until after cancellation, expiry, or termination of the Employer’s subscription;
  8. disguising the Hire as consultancy, freelance work, contractor work, project work, paid trial work, or engagement through another entity.

Unless otherwise stated in a separate written agreement, the non-circumvention period lasts for 12 months from the date of the Introduction — that is, the date on which, following an interview request made by the Employer through CVHound.com, CVHound.com first unlocks or makes available to that Employer the Candidate’s CV, resume, full name, contact details, LinkedIn profile, specific past-employer details, or other restricted identifying Candidate information.

If an Employer hires a Candidate during this period, a Placement Fee will be payable.

CVHound.com may invoice the Employer for the Placement Fee once it becomes aware of a Hire or once a Hire is deemed confirmed in accordance with these Terms.

Placement Fees are payable within 14 days of invoice date unless otherwise agreed in writing.

14. Placement Fee Basis, Advertised Maximum Salary, and Evidence-Based Discount

Unless otherwise agreed in writing, the standard Placement Fee is calculated at 5% of the Advertised Maximum Salary for the relevant role.

The Employer acknowledges that the Advertised Maximum Salary is used as the standard contractual fee basis because it is the salary figure entered, disclosed, advertised, posted, or represented by the Employer in connection with the role and is therefore the salary basis available to CVHound.com for calculating the Placement Fee.

Where the Platform automatically calculates the Placement Fee on the Advertised Maximum Salary, that calculation reflects the standard contractual fee basis agreed by the Employer when submitting or confirming the interview request.

Where the Candidate’s actual Confirmed Start Salary is lower than the Advertised Maximum Salary, the Employer may request an evidence-based reduction of the Placement Fee so that the Placement Fee is calculated on the Confirmed Start Salary instead of the Advertised Maximum Salary.

This reduction is a voluntary fee adjustment mechanism made available by CVHound.com to Employers who provide satisfactory evidence of the Candidate’s actual agreed starting salary. It is intended to allow accurate fee calculation where the Employer provides evidence of the lower salary actually agreed.

To request this reduction, the Employer must provide a complete and accurate Offer Letter or other evidence accepted by CVHound.com within 14 days of the date of the pro-forma notice, start-confirmation request, or invoice, whichever is first issued in relation to the relevant Hire.

If the Employer provides satisfactory evidence within the required period, CVHound.com may reduce or adjust the Placement Fee so that it is calculated as 5% of the Candidate’s Confirmed Start Salary.

If the Employer does not provide satisfactory evidence within the required period, the Placement Fee will remain calculated on the Advertised Maximum Salary.

The Employer agrees that calculation of the Placement Fee on the Advertised Maximum Salary is the standard contractual fee basis and that any reduction based on Confirmed Start Salary is an evidence-based discount or adjustment, not a penalty, fine, or charge for breach.

CVHound.com may use AI-assisted tools and manual review to extract, confirm, or verify salary information from Offer Letters or other evidence provided by the Employer or Candidate.

Where remuneration is not expressed as a fixed annual salary, CVHound.com may calculate the fee using a reasonable annualised equivalent, including day rate, hourly rate, contract value, expected annual package, fixed-term value, or other available remuneration information.

Where the role includes guaranteed bonus, guaranteed commission, allowances, signing payments, or other guaranteed first-year remuneration, CVHound.com may include such guaranteed amounts in the salary or remuneration basis unless otherwise agreed in writing.

15. Start Confirmation, Pro-Forma Notices, Deemed Confirmation, and Invoicing

After a Candidate’s expected start date, CVHound.com may contact the Employer to confirm whether the Candidate has started, will start on a different date, or did not start.

CVHound.com may send start-confirmation requests to the Employer owner, HR contact, accounts contact, hiring manager, finance contact, or other Employer contact supplied through the Platform.

Start-confirmation requests and related notices may be sent by email, dashboard notification, Secure Email Link, or other reasonable communication method.

The start-confirmation process may include an initial confirmation request asking whether the Candidate started; a reminder if no response is received; a pro-forma notice showing the Placement Fee amount that may be invoiced if the Employer does not respond; and a final notice or invoice if no response is received within the stated period.

A pro-forma notice is not a VAT invoice and is not payable unless and until a valid invoice is issued.

If the Employer confirms that the Candidate did not start, no automatic Placement Fee invoice will be raised at that stage and the matter may be reviewed manually.

If the Employer confirms a different expected start date, CVHound.com may update the record and repeat the start-confirmation process after the revised date.

If the Employer does not respond within 14 days of the initial start-confirmation request, and CVHound.com has sent a reminder or pro-forma notice stating the deadline and the amount that may be invoiced, the Employer agrees that CVHound.com may treat the Hire as confirmed for invoicing purposes, record the placement as hired, and issue a payable invoice.

The Employer agrees that non-response within this 14-day period, following clear notice and a stated deadline, may be treated by CVHound.com as deemed confirmation of the Hire for invoicing and Platform administration purposes.

Where a Hire is deemed confirmed due to non-response, the Placement Fee may be calculated on the Advertised Maximum Salary unless the Employer provides satisfactory evidence of a lower Confirmed Start Salary within the evidence window described in these Terms.

The Employer acknowledges that the deemed-confirmation process is intended to allow CVHound.com to administer billing where the Employer does not respond to clear start-confirmation requests, reminders, and pro-forma notices.

The Employer remains entitled to dispute an invoice in good faith if it believes the Candidate did not start or if the invoiced salary basis is incorrect, but must provide evidence supporting the dispute promptly and no later than 14 days after the invoice date.

CVHound.com may use email sent records, delivery records, bounce records, Platform logs, Secure Email Link logs, response logs, pro-forma records, and communication records to evidence that notices were sent, delivered, made available, or responded to.

CVHound.com may also use email open, click, and engagement records where such tracking is implemented and described in the Privacy Policy.

16. Employer Subscriptions

Employers may be required to purchase a subscription to access Candidate search tools, Profile information, interview request tools, or other employer features.

Unless otherwise stated on the Platform or agreed in writing, the annual Employer Subscription Fee is £4,999 per year.

Subscription Fees are charged via Stripe or another payment provider at registration or renewal, in advance.

Subscription pricing, billing periods, access levels, and included features will be displayed on the Platform or agreed separately in writing.

Unless stated otherwise: Subscription Fees are payable in advance; Subscription Fees are non-refundable once employer access has been provided; a subscription does not guarantee any minimum number of interviews, hires, responses, suitable Candidates, or successful placements; we may update subscription pricing, packages, or features from time to time; and any pricing changes will apply from the next billing period unless otherwise stated.

Failure to pay Subscription Fees may result in suspension or termination of Employer access.

Subscription Fees do not include Placement Fees unless expressly stated in writing.

17. Fees, Invoicing, Payment, and Taxes

Employers must pay all Subscription Fees, Placement Fees, and other charges due under these Terms or any separate written agreement.

All fees are exclusive of VAT unless expressly stated otherwise.

Where VAT, sales tax, withholding tax, or any other applicable tax is payable, it may be added to the invoice or handled as required by applicable law.

Invoices must be paid within the payment period stated on the invoice or, if no period is stated, within 14 days of the invoice date.

If any invoice email, PDF, pro-forma, or other document states a different payment period by mistake, the payment period stated in these Terms shall apply unless CVHound.com expressly agrees otherwise in writing.

If an Employer fails to pay an invoice when due, CVHound.com may suspend or terminate Platform access; charge interest on overdue sums in accordance with applicable law; recover reasonable debt collection costs; withhold further services; or take legal action to recover unpaid fees.

Employers must not set off, withhold, or deduct payment unless required by law or agreed in writing by CVHound.com.

Employers are responsible for any bank charges, currency conversion charges, payment processing fees, taxes, duties, withholding taxes, or similar charges applicable to payments made to CVHound.com, unless otherwise agreed in writing.

Fees may be charged in GBP, EUR, USD, or another currency displayed on the Platform or agreed in writing.

18. Candidate Bonus

CVHound.com may offer a Candidate Bonus to eligible Candidates who are successfully placed with an Employer through CVHound.com.

The Candidate Bonus only applies where it is expressly displayed on the Platform, offered in writing by CVHound.com, or otherwise confirmed by CVHound.com as applying to the relevant Candidate and placement.

Unless otherwise stated on the Platform or agreed in writing, the Candidate Bonus is 1% of the Candidate’s Confirmed Start Salary, capped at £/€/$1,000, depending on the currency applicable to the placement.

The Candidate Bonus applies to permanent placements only unless CVHound.com expressly states otherwise in writing.

The Candidate Bonus is only earned if all of the following conditions are met:

  1. the Candidate was introduced to the Employer through CVHound.com;
  2. the Candidate accepts and starts the permanent role;
  3. the Candidate remains in continuous employment in the role for at least 90 days from the start date;
  4. the Employer confirms the Hire or the Hire is otherwise verified by CVHound.com;
  5. CVHound.com receives the relevant Placement Fee from the Employer in full and in cleared funds;
  6. the Candidate has complied with these Terms;
  7. the Candidate provides any payment details, identity details, tax details, or other information reasonably required by CVHound.com to process the bonus.

The Candidate Bonus is not payable if the Candidate does not start the role; leaves before completing 90 days’ continuous employment; is dismissed, terminated, or removed before completing 90 days’ continuous employment; the placement is not a permanent placement (unless CVHound.com expressly states otherwise in writing); the Employer does not pay the Placement Fee in full; the Hire cannot be verified; the Candidate has provided false or misleading information; the Candidate has breached these Terms; or payment would be unlawful or impractical due to sanctions, banking restrictions, tax restrictions, identity verification failure, or other legal or compliance reasons.

The Candidate Bonus is paid by CVHound.com and not by the Employer.

The Candidate Bonus is paid only from or after receipt of the relevant Placement Fee by CVHound.com. CVHound.com is not required to pay the Candidate Bonus before receiving the Placement Fee in full and in cleared funds.

The Candidate is responsible for any tax, reporting, social security, income tax, national insurance, or other obligations arising from receipt of the Candidate Bonus.

CVHound.com may withhold, delay, reduce, or refuse payment of the Candidate Bonus where required by law, tax rules, fraud prevention, dispute, compliance checks, sanctions screening, or regulatory obligations.

The Candidate Bonus is not salary, wages, employment income paid by CVHound.com, or evidence of any employment relationship between the Candidate and CVHound.com.

CVHound.com may withdraw, suspend, amend, or remove the Candidate Bonus scheme for future placements at any time, provided this does not remove a Candidate Bonus already earned under these Terms.

19. 90-Day Service Guarantee for Employers

CVHound.com may offer Employers a 90-day service guarantee in relation to certain successful placements.

Unless otherwise stated in a separate written agreement, the 90-day service guarantee provides replacement search support or a replacement search credit only. It does not provide an automatic cash refund, rebate, or credit note.

The guarantee applies only where:

  1. the Employer has paid all Subscription Fees and Placement Fees when due;
  2. the Candidate was introduced through CVHound.com;
  3. the Candidate started the role;
  4. the Candidate leaves or is terminated within 90 days of the start date;
  5. the Employer notifies CVHound.com in writing within 14 days of the Candidate leaving or being terminated;
  6. the Employer provides reasonable information requested by CVHound.com about the circumstances;
  7. the Employer has complied with these Terms.

The guarantee does not apply where the Employer has not paid the relevant Placement Fee; the Candidate leaves due to redundancy, restructuring, relocation, change of role, change of reporting line, change of working conditions, non-payment by the Employer, unlawful treatment, unsafe working conditions, discrimination, harassment, or other Employer-related issue; the Employer materially changes the role, salary, location, hours, contract type, duties, or working arrangement after the Candidate accepts; the Candidate is dismissed due to redundancy or business restructuring; the Employer fails to onboard, manage, support, or pay the Candidate properly; the Employer breaches these Terms; the Employer has concealed, delayed, or misreported the Hire; or the Employer refuses reasonable replacement support.

Any replacement support is limited to the same or substantially similar role unless otherwise agreed in writing.

The 90-day service guarantee is the Employer’s sole remedy in relation to an early departure, unless otherwise agreed in writing.

CVHound.com may agree a different guarantee, rebate, credit, or refund arrangement in a separate written agreement. No such arrangement applies unless expressly agreed in writing by CVHound.com.

20. Refunds

Use of CVHound.com is currently free for Candidates.

Subscription Fees paid by Employers are non-refundable once employer access has been provided, unless otherwise required by law or agreed in writing.

Placement Fees are non-refundable unless expressly agreed in writing or unless a specific written guarantee applies.

No refund will be due where an Employer does not find a suitable Candidate; does not receive Candidate responses; does not hire a Candidate; fails to use the Platform; breaches these Terms; has its account suspended or terminated due to misuse; or fails to cooperate with replacement support under the 90-day service guarantee.

CVHound.com may issue refunds or credits at its sole discretion, but doing so does not create an obligation to provide future refunds or credits.

21. Employer Data Protection Obligations

Employers acknowledge that Candidate Profiles and CV/resume-related information made available through CVHound.com contain personal data.

Employers must process all Candidate Data in accordance with Applicable Data Protection Laws and all applicable employment, equality, privacy, recruitment, and anti-discrimination laws.

Where an Employer accesses, views, stores, downloads, records, receives, or otherwise processes Candidate Data through CVHound.com, the Employer acts as an independent data controller, business, or equivalent responsible party for its own recruitment processing activities, depending on the privacy laws that apply to that Employer.

Employers must only process Candidate Data for genuine recruitment purposes connected with assessing, interviewing, communicating with, offering work to, hiring, or engaging the relevant Candidate.

Employers must not process Candidate Data for marketing; resale; speculative outreach unrelated to the Candidate’s stated interests; database building; data enrichment; profiling unrelated to recruitment; automated decision-making that produces legal or similarly significant effects without appropriate safeguards; discriminatory screening; disclosure to unauthorised third parties; or any unlawful or non-recruitment purpose.

Employers must have a lawful basis, legal permission, or equivalent valid ground under applicable law for any processing of Candidate Data they carry out after receiving or accessing such data through CVHound.com.

Employers are responsible for providing any privacy notices required by law where they independently process Candidate Data.

Employers must ensure that only authorised personnel with a genuine recruitment need can access Candidate Data, and must implement appropriate technical and organisational measures to protect Candidate Data against unauthorised access, loss, misuse, alteration, disclosure, or destruction.

Employers must promptly notify CVHound.com if they become aware of any unauthorised access, loss, misuse, disclosure, or breach involving Candidate Data obtained through the Platform, and must cooperate with CVHound.com in investigating and addressing any suspected misuse, breach, complaint, regulatory enquiry, data subject request, or legal claim relating to Candidate Data.

22. Restrictions on Scraping, Exporting, and Database Building

Users must not scrape, harvest, bulk download, copy, export, reproduce, compile, index, mirror, or create an external database from Candidate Profiles, Candidate Data, Employer Data, vacancy data, Platform data, or other content made available through CVHound.com.

Users must not use automated tools, bots, scripts, crawlers, browser extensions, scraping systems, data extraction tools, monitoring tools, AI agents, or similar technologies to access, copy, extract, store, analyse, or monitor Platform data.

Employers may only store Candidate Data outside CVHound.com where reasonably necessary for a genuine recruitment process involving that specific Candidate.

Employers must delete or anonymise Candidate Data when it is no longer required for the relevant recruitment process or any lawful record-keeping purpose.

Employers must not retain Candidate Data indefinitely or use CVHound.com as a source for building a separate talent pool, recruitment database, mailing list, CRM database, candidate marketplace, data product, or competing service.

Candidates must not scrape, copy, extract, or misuse Employer Data, vacancy data, Platform content, or other user data.

23. International Use, Overseas Users, and Cross-Border Data

CVHound.com is operated from the United Kingdom.

Users may access the Platform from other countries, but each User is responsible for ensuring that their use of the Platform is lawful in the country or territory from which they access it or in which they recruit, work, hire, operate, or receive services.

Employers are responsible for complying with all local laws applicable to their recruitment activities, including employment law, immigration law, right-to-work checks, worker classification, contractor engagement rules, tax obligations, equal opportunities laws, anti-discrimination laws, recruitment advertising rules, and privacy/data protection laws.

Candidates are responsible for ensuring that they are legally entitled to seek, apply for, accept, or perform work in any country where they pursue opportunities through CVHound.com.

Candidates acknowledge that CVHound.com may make their Profile available to Employers located outside the United Kingdom and European Economic Area where the Candidate has made their Profile searchable and where such Employers use the Platform for genuine recruitment purposes.

Where Candidate Data is disclosed to an overseas Employer, that Employer is responsible for complying with applicable local privacy, data protection, employment, recruitment, immigration, tax, and worker classification laws.

Employers must not transfer Candidate Data outside the United Kingdom, European Economic Area, or the country where the Candidate is located unless they have appropriate lawful safeguards in place as required by applicable data protection law.

Where an Employer is based outside the United Kingdom or European Economic Area, or where Candidate Data may be accessed by personnel, group companies, service providers, systems, or contractors outside the United Kingdom or European Economic Area, the Employer is responsible for ensuring that such access and transfer complies with applicable data protection law.

CVHound.com may process, host, store, access, or transfer personal data in countries outside the United Kingdom or the country where a User is located. This may occur where we use hosting providers, cloud infrastructure, AI providers, email providers, analytics providers, security tools, customer support tools, payment providers, or where Candidate Data is made available to Employers located in other countries.

Where required by Applicable Data Protection Laws, CVHound.com will use appropriate safeguards for international transfers, which may include adequacy regulations, standard contractual clauses, the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, transfer risk assessments, contractual controls, and technical and organisational security measures.

CVHound.com is operated from the United Kingdom and processes personal data in accordance with applicable UK data protection laws. Where EU data protection laws or other local privacy laws apply to CVHound.com’s processing of personal data, CVHound.com will take reasonable steps to comply with those applicable requirements.

Depending on where a User is located, they may have additional privacy rights under local law. Details of how Users can exercise privacy rights are set out in the Privacy Policy.

CVHound.com does not represent that the Platform is appropriate, lawful, or available for use in every country or territory. We may restrict access to the Platform, Candidate Profiles, Employer features, or particular services in any country or territory where we believe this is necessary for legal, regulatory, security, operational, or commercial reasons.

24. Candidate Account Deletion, Consent Withdrawal, and Data Retention

Candidates may request deletion of their account at any time through their dashboard where that functionality is available, or by emailing CVHound.com.

When a Candidate account is deleted, their Profile will be removed from active employer search results; their CV or resume will be removed from the searchable database; Hampshire Barnes Ltd will stop contacting them about new roles, unless another lawful basis applies; and Employers who have already received their details through an accepted interview request remain responsible for their own compliance with applicable data protection law in relation to that data.

CVHound.com may retain limited records where necessary for legal, tax, accounting, audit, fraud prevention, security, dispute resolution, regulatory, or contractual enforcement purposes.

This may include consent audit records, profile view logs, interview request records, shortlist records, message metadata, start-confirmation records, email sent/delivery records, email open/click records where implemented, secure-link records, hire confirmation records, Offer Letters, parsed salary records, invoice records, payment records, Candidate Bonus records, guarantee records, and platform activity logs.

Such records will normally be retained for up to 24 months from the relevant platform activity unless a longer period is required for legal, accounting, tax, dispute, regulatory, or enforcement purposes.

Offer Letters and parsed salary data used for fee calculation, discount evidence, invoicing, dispute handling, Candidate Bonus calculation, or guarantee administration may be retained for up to 24 months from the relevant placement activity unless a longer period is required for legal, accounting, tax, dispute, regulatory, or enforcement purposes.

Where deletion is not automated, CVHound.com may handle deletion, anonymisation, or retention operationally in accordance with its internal procedures and the Privacy Policy.

Candidate deletion from CVHound.com does not automatically delete copies of Candidate Data already lawfully held by an Employer. Employers must not retain Candidate Data for longer than necessary for the relevant recruitment process or any lawful record-keeping purpose.

25. Communications and Email Tracking

By creating an account, supplying contact details, accepting fee terms, submitting an interview request, or otherwise using the Platform, Users agree to receive service-related communications from CVHound.com.

Candidate communications may include account verification and security messages; interview requests from Employers; notifications relating to their Profile or account; messages from Hampshire Barnes Ltd about roles it is recruiting for; hire-status enquiries; Candidate Bonus communications where applicable; and service announcements and Platform updates.

Employer communications may include account verification and security messages; subscription, billing, and invoice communications; Candidate interview request updates; start-confirmation requests; hire-status enquiries; secure-link communications; pro-forma notices; Placement Fee communications; guarantee communications; and service announcements and Platform updates.

CVHound.com may use email sent, delivery, bounce, failure, Secure Email Link, and response records in transactional, service, start-confirmation, pro-forma, billing, invoice, and legal communications to help evidence delivery, response, timing, and administration of important notices.

CVHound.com may also use email open, click, and engagement tracking where such functionality is implemented. This may include tracking pixels or tracked links. Where used, this will be described in the Privacy Policy.

Users may opt out of optional marketing communications at any time. Users cannot opt out of essential service communications while they have an active account or while contractual, billing, legal, or enforcement matters remain outstanding.

26. Cookies and Similar Technologies

CVHound.com may use cookies and similar technologies that are necessary for login, authentication, session security, account management, fraud prevention, and essential Platform operation.

Where CVHound.com uses only essential cookies, those cookies are required for the Platform to work and may not require a cookie consent banner.

Where CVHound.com uses non-essential cookies, analytics cookies, advertising cookies, or similar technologies that require consent, CVHound.com will provide appropriate notice and obtain consent where required by law.

27. User Conduct

Users must use CVHound.com professionally, lawfully, and in good faith.

27.1 Candidate Conduct

Candidates must not:

  1. impersonate any other person or create fake Profiles;
  2. upload false or misleading qualifications, work history, or credentials;
  3. upload CVs or resumes belonging to other people;
  4. harass, threaten, abuse, or mislead Employers, recruiters, CVHound.com staff, or other users;
  5. use the Platform to send spam, marketing, or non-recruitment communications;
  6. use the Platform to advertise services, sell products, or solicit business;
  7. attempt to bypass Platform restrictions, access controls, or security controls;
  8. scrape, copy, or extract Employer Data, vacancy data, or Platform content;
  9. use automated tools, bots, or scripts to interact with the Platform;
  10. interfere with the security, operation, or integrity of the Platform;
  11. knowingly assist an Employer in avoiding, concealing, delaying, or misreporting a Hire to avoid Placement Fees.

27.2 Employer Conduct

Employers must not:

  1. post, promote, or offer unlawful, misleading, discriminatory, exploitative, unpaid, or fake roles;
  2. misrepresent their identity, company, role, hiring authority, or intentions;
  3. contact Candidates for non-recruitment purposes;
  4. harass, pressure, mislead, or abuse Candidates;
  5. request inappropriate personal information from Candidates;
  6. discriminate unlawfully against Candidates;
  7. use the Platform to source Candidates for third-party recruitment agency activity unless expressly authorised by CVHound.com in writing;
  8. interfere with the security, operation, or integrity of the Platform;
  9. attempt to bypass Platform restrictions, access controls, payment systems, or privacy controls;
  10. use Candidate Data in breach of these Terms;
  11. attempt to circumvent Subscription Fees or Placement Fees;
  12. offer roles or working arrangements that breach applicable employment, immigration, tax, recruitment, worker classification, or anti-discrimination laws.

CVHound.com may investigate suspected misuse and may suspend or terminate accounts where we reasonably believe a User has breached these Terms or created risk for Candidates, Employers, CVHound.com, Hampshire Barnes Ltd, or other users.

28. No Third-Party Recruitment Agency Transfer

CVHound.com is operated by Hampshire Barnes Ltd.

Candidate Data is not shared with third-party recruitment agencies through CVHound.com unless expressly stated or authorised.

Candidate Profile data may be made available to subscribed direct Employers in accordance with these Terms and the CVHound.com Privacy Policy.

Hampshire Barnes Ltd may also use Candidate Profiles, CVs, resumes, AI Output, and related Candidate Data to identify suitable roles and contact Candidates about roles it is recruiting for on behalf of its own clients, as explained in these Terms and the Privacy Policy.

Employers must not use CVHound.com to source Candidates on behalf of recruitment agencies, staffing agencies, labour suppliers, outsourcing companies, or third-party hiring intermediaries unless CVHound.com has given prior written approval.

29. Employer Responsibility for Hiring Decisions

CVHound.com does not guarantee the accuracy, completeness, suitability, legality, availability, or reliability of Candidate Profiles, CVs, resumes, qualifications, experience, references, right-to-work status, salary expectations, work authorisation, location, or other Candidate information.

Employers are solely responsible for assessing Candidate suitability; conducting interviews; verifying qualifications; checking references; carrying out right-to-work checks; carrying out background checks where lawful and appropriate; complying with employment law; complying with immigration law; complying with tax law; complying with equality and anti-discrimination law; classifying workers, employees, contractors, consultants, or freelancers correctly; and agreeing employment or engagement terms directly with Candidates.

CVHound.com is not responsible for any hiring decision, employment relationship, contract, dispute, loss, claim, or liability arising between an Employer and a Candidate.

30. No Employment Guarantee for Candidates

CVHound.com does not guarantee that any Candidate will be contacted by any Employer; receive any interview requests; receive any job offers; secure any role, contract, or engagement; earn any particular salary or income; achieve any particular career outcome; or receive a Candidate Bonus unless all bonus conditions are satisfied and the bonus has been expressly offered by CVHound.com.

The decision to interview, hire, or engage any Candidate is made solely by the Employer.

Candidates are responsible for assessing whether any Employer, role, contract, salary, working arrangement, location, visa requirement, tax position, or opportunity is suitable for them before accepting an interview, offer, or engagement.

31. Platform Availability and Changes

CVHound.com aims to provide a reliable Platform but does not guarantee uninterrupted, error-free, or continuous access.

The Platform may be unavailable due to maintenance, updates, technical issues, security incidents, hosting failures, third-party service issues, legal restrictions, regional restrictions, or events outside our control.

We may update, modify, restrict, replace, suspend, or discontinue any part of the Platform at any time.

We are not liable for any loss arising from Platform downtime, changes, maintenance, errors, regional restrictions, or unavailability.

32. Intellectual Property

Candidates retain ownership of the content they upload to CVHound.com, including their CV, resume, and Profile information.

By uploading content to CVHound.com, Candidates grant CVHound.com and Hampshire Barnes Ltd a non-exclusive, royalty-free, worldwide licence to host, store, display, process, structure, summarise, search, match, analyse, use, and share their CV, resume, Profile, AI Output, and related Candidate Data for the purposes set out in these Terms and the Privacy Policy, including making the Candidate searchable to Employers and allowing Hampshire Barnes Ltd to identify and contact the Candidate about suitable roles.

This licence ends when the Candidate deletes their account, except where CVHound.com is required or permitted to retain content under applicable law or for legitimate record-keeping purposes.

All intellectual property rights in the Platform, including the website, software, design, branding, database structure, search tools, workflows, content, AI-assisted processing systems, billing systems, and documentation, belong to CVHound.com, Hampshire Barnes Ltd, or our licensors.

Users are granted a limited, revocable, non-exclusive, non-transferable right to access and use the Platform in accordance with these Terms.

Users must not copy, reproduce, modify, reverse engineer, resell, licence, distribute, or commercially exploit any part of the Platform without prior written consent.

Candidate Data does not become the property of an Employer.

33. Confidentiality

Users must keep confidential any non-public information obtained through CVHound.com, including Candidate Data, Employer Data, Platform functionality, pricing terms, commercial arrangements, technical systems, billing processes, and business information.

Employers must not disclose Candidate Data to unauthorised third parties except where necessary for a genuine recruitment process, required by law, or authorised by CVHound.com.

This confidentiality obligation continues after a User stops using CVHound.com.

34. Account Suspension and Termination

CVHound.com may suspend, restrict, or terminate a User account immediately where we reasonably believe that the User has:

  1. breached these Terms;
  2. provided false, misleading, or fake information;
  3. impersonated another person or organisation;
  4. uploaded a CV or resume belonging to another person without authority;
  5. misused Candidate Data or Employer Data;
  6. attempted to circumvent Subscription Fees or Placement Fees;
  7. scraped, copied, exported, or harvested Platform data;
  8. used the Platform for non-recruitment purposes;
  9. harassed, misled, or abused other users;
  10. attempted to bypass Platform restrictions or security controls;
  11. breached applicable law;
  12. breached data protection law;
  13. created legal, commercial, security, regulatory, or reputational risk for CVHound.com, Hampshire Barnes Ltd, Candidates, Employers, or other users.

Where an Employer account is suspended or terminated due to breach or misuse, no refund will be due.

Termination does not affect any obligations or liabilities that arose before termination, including payment obligations, Placement Fees, confidentiality obligations, data protection obligations, non-circumvention obligations, candidate bonus records where applicable, guarantee records, consent audit records, and historic platform activity records lawfully retained under our Privacy Policy.

35. Privacy Policy

Use of CVHound.com is also governed by our Privacy Policy.

The Privacy Policy explains how CVHound.com collects, uses, stores, shares, transfers, and protects personal data, including CV content, resume content, Profile data, Candidate Data, Employer Data, Offer Letters, salary data, communications, AI Output, email records, secure-link records, tracking records where implemented, and platform activity.

Users must read and understand the Privacy Policy before using the Platform.

If there is any conflict between these Terms and the Privacy Policy in relation to CVHound.com’s processing of personal data, the Privacy Policy will apply to that processing.

36. Limitation of Liability

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

Subject to the above, CVHound.com and Hampshire Barnes Ltd will not be liable for:

  1. failure by a Candidate to secure employment, interviews, offers, or career outcomes;
  2. failure by an Employer to find suitable Candidates, secure interviews, or make successful hires;
  3. Employer conduct or hiring decisions;
  4. Candidate conduct or inaccurate Candidate information;
  5. inaccurate or misleading information posted by Employers;
  6. loss of income, earnings, revenue, business, profit, anticipated savings, goodwill, opportunity, or data;
  7. indirect or consequential loss;
  8. Platform downtime or technical issues;
  9. third-party services linked to or referenced through the Platform;
  10. employment disputes, contract disputes, or hiring disputes between Candidates and Employers;
  11. immigration, tax, worker classification, right-to-work, or employment compliance issues between Candidates and Employers;
  12. local law restrictions affecting access to or use of the Platform;
  13. loss arising from Employer failure to monitor supplied contact email addresses;
  14. loss arising from authorised or unauthorised internal Employer use of Secure Email Links, except where caused by CVHound.com’s own proven negligence or unlawful conduct.

Because CVHound.com is currently provided free of charge to Candidates, our total liability to any Candidate arising out of or in connection with these Terms shall be limited to the maximum extent permitted by law.

CVHound.com’s total aggregate liability to an Employer arising out of or in connection with these Terms shall not exceed the total fees paid by that Employer to CVHound.com in the 3 months preceding the event giving rise to the claim.

37. Employer Indemnity

The Employer agrees to indemnify and hold harmless CVHound.com and Hampshire Barnes Ltd from and against any claims, losses, damages, fines, penalties, liabilities, costs, and expenses arising from:

  1. the Employer’s breach of these Terms;
  2. misuse of Candidate Data;
  3. breach of data protection law;
  4. breach of employment law;
  5. breach of immigration law;
  6. breach of tax law;
  7. breach of equality or anti-discrimination law;
  8. unlawful or inappropriate recruitment practices;
  9. incorrect worker classification;
  10. non-payment of fees;
  11. circumvention of Placement Fees;
  12. unauthorised disclosure of Candidate Data;
  13. international transfer of Candidate Data in breach of applicable law;
  14. claims brought by Candidates arising from the Employer’s conduct;
  15. false, incomplete, or misleading start-confirmation, salary, Offer Letter, or hire-status information supplied by the Employer;
  16. actions taken through Secure Email Links sent to Employer-supplied contact email addresses.

38. Changes to These Terms

CVHound.com may update these Terms from time to time.

Where changes are material, we may notify Users by email, dashboard notice, website notice, or other reasonable means.

Continued use of CVHound.com after updated Terms take effect means the User accepts the updated Terms.

If a User does not agree to updated Terms, they must stop using the Platform. Candidates who do not agree to updated Terms may request deletion of their account.

Employers who do not agree to updated Terms must stop using the Platform, but any payment obligations, Placement Fees, non-circumvention obligations, data protection obligations, confidentiality obligations, Candidate Bonus records where applicable, guarantee records, and liabilities already incurred will remain in force.

39. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, the Platform, Candidate Data, Employer Data, Subscription Fees, Placement Fees, Candidate Bonuses, Offer Letters, invoices, Secure Email Links, or use of CVHound.com.

Nothing in these Terms prevents CVHound.com from seeking injunctive, equitable, debt recovery, or enforcement relief in another jurisdiction where necessary to protect its rights, recover unpaid sums, prevent misuse of Candidate Data, enforce non-circumvention obligations, enforce payment obligations, or protect the Platform.
